Gov Pritzker and ISBE Sued Over Newest Mask Mandate –

Clinton County, IL. (ECWd) –

A lawsuit was filed today in Clinton County, Illinois, naming Governor Pritzker and Dr. Carmen Ayala, Director of the Illinois State Board of Education, as defendants. Jeremy Pates, a parent, is Plaintiff.

The essence of this suit is a challenge to Governor Pritzker’s authority to force local school boards to adhere to “guidance” issued by the ISBE and IDPH, and a challenge to ISBE’s authority to decertify a local school district as they have implied they will do for noncompliance.

This Complaint is alleging that Governor Pritzker has no authority to create substantive law which usurps the authority of the local school board.

Relief requested:

  • Declaration that Pritzker has no authority to compel local school boards to follow joint guidance issued by the Illinois Department of Health or the Illinois State Board of Education during times of an emergency
  • Declaration that the ISBE has no authority to revoke, suspend, or otherwise penalize, the recognition status of a local school district for failure to adhere to the recommended guidelines of ISBE and IDPH during times of an emergency
  • Award parent his costs incurred
