Cindy Brzana Defeats Wesley Township's Motion to Dismiss 35-Count FOIA Case -

BY JOHN KRAFT & KIRK ALLEN

ON September 2, 2020

Wesley Twp, IL. (ECWd) -

In an Order dated Sep 1, 2020, the Circuit Court DENIED Wesley Township's Motion to Dismiss the FOIA lawsuit.

Wesley's Motion was essentially arguing that since they finally produced all the records, that the suit was now moot, and they should not have to pay attorney fees.

We had previously written about the former Township Clerk's signed and sworn affidavit admitting that she willfully and intentionally refused to answer FOIA requests because of her own personal and political reasons.

A Motion for Summary Judgment in favor of Plaintiff has been filed and scheduled for Hearing on November 12, 2020, at 9:30 a.m. in Will County Circuit Court.

Read Judge Anderson's seven-page Order DENYING Wesley's Motion to Dismiss:
