Our FOIA Lawsuit vs. Shelby County Still Continuing –

By John Kraft & Kirk Allen

On September 2, 2025

Shelby Co., Ill. (ECWd) –

Our Freedom of Information Act (“FOIA”) lawsuit against Shelby County and its State’s Attorney is still moving forward, despite the local, anonymous premature celebrations.

There was a hearing today on our Motion to Vacate the dismissal ordered last month. Our attorneys were never notified of last month’s August 19, 2025, status hearing, as can be found written in the several sworn affidavits presented with our motion to vacate.

The Court granted our motion to vacate and set a status hearing for October 7, 2025, at 9:00 a.m.

  1. They were meeting for status appearances it appears monthly. The attorney should have looked or contacted to find out when the next court date was when they missed the first date with notification in my thought.

  2. I wonder how “our attorneys were never notified” could have happened in a flawless county such as Shelby County? It would appear to some, this was not a mistake but a deliberate omission. Who really knows for sure? Just saying it looks pretty suspicious and far more than coincidental. How convenient.
