Madison County State’s Attorney Facing FOIA Lawsuit –

Madison County State’s Attorney was sued for alleged violations of the Freedom of Information Act. This involves two separate FOIA requests where Plaintiff alleges Defendant’s response violated the FOIA. Plaintiff also seeks a Judge from outside the Third Judicial Circuit to Hear the case.

Subject: Statement on Lawsuit Against Madison County Illinois States Attorney

I filed a lawsuit Friday in Madison County Circuit Court against the Madison County State’s Attorney for violating the Illinois Freedom of Information Act. (see filed copy)

This suit and another filed last week against the Madison County Treasurer were filed due to circumstances and delays at the Illinois Attorney General’s Public Access Counselor’s Office (PAC).

I have had many PAC decisions ruled in my favor, but the Illinois Attorney General’s PAC process can be time consuming and circumstances recently have slowed progress at the PAC.

It is my understanding that on April 10th 2021 the Illinois Attorney General discovered a computer network ransomware attack which has significantly disrupted its ability to determine and resolve potential Freedom of Information Act violations through the PAC.

It is my opinion that due to the ransom attack on the Illinois Attorney General, my best remedy for determining and resolving the FOIA violations I have encountered in Madison County is through Madison County Circuit Court.

    What are they hiding in Madison County? Other than decades of political backroom dealing on county time…Republicans and Democrats in Madison County are united in one thing…don’t let the public find out!
